PREAMBLE

PURPOSE: (1) To promote a cooperative approach among ourselves, our supervisors, administrative staff and the Head Start community, and to elevate and nurture the growth and education of children and families, we, the employees of Head Start join our efforts and aims through the formation of this organization. (2) To promote the interest of education within this community and also the State of Oregon. (3) To advance the standards of the Head Start employees for occupational development. (4) To promote the economic and social welfare of the Head Start employees. (5) To promote the unity and communication among Head Start employees for the achievement of these goals. (6) To assist the State Association in achievement of its goals.

ARTICLE I - NAME

This organization shall be known as the Oregon School Employees Association, Chapter No. 600.

ARTICLE II - MEMBERSHIP

A. Active - Any member of the bargaining unit may become a member of Chapter #600 upon completion of the proper enrollment card.

"Active" means any employee in the employ of Head Start or who is on any type of paid or unpaid leave of absence to include a lay-off list. An active member who is on an unpaid leave of absence in excess of six (6) months is not required to pay dues, but may elect to do so and shall be a full member for all purposes during the unpaid leave of absence.

B. Inactive - A member who leaves the employment of Head Start will be placed on inactive status and upon re-employment will be entitled to reinstatement of membership without payment of initiation fees, if any.

ARTICLE III - DUES

 
Chapter #600 of the Oregon School Employees Association shall have dues assessed on the members that shall provide for the per capita dues as established by the delegates at the Oregon School Employees Association's Annual Conference. Chapter #600 may have local dues in addition to the per capita dues as determined by the membership of Chapter #600.

ARTICLE IV - OFFICERS

 
The officers of the chapter shall be a president, vice-president, secretary, treasurer and the nine (9) Area Representatives. These elected officers shall comprise the Executive Board of OSEA Chapter. #600. Area representatives shall include a representative from each of the seven (7) regions, a representative from Food Services, and a representative from Transportation. The nine (9) Area Representative positions shall be filled by the President with the advice and consent of the Executive Board.

ARTICLE V - TERM OF OFFICE

The elected officers shall be elected for a two (2)-year term. The election of officers shall be in May of each year, with the nominations of officers being held at the March and April Chapter meetings.

OFFICERS ARTICLE VI - DUTIES OF THE OFFICERS

6.1 President

The President shall preside at all meetings of Chapter #600 and shall preside at all meetings of the Executive Board. He/She shall enforce the usual parliamentary rules and shall appoint committees as deemed necessary by the Constitution of the chapter for the accomplishment of the purposes of the chapter. He/She shall be an ex-officio member of all committees of the chapter and may attend meetings of the committees. He/She shall supervise and be responsible for all officers and committees in performing their duties and shall enforce a strict observance of the Constitution of the chapter. He/She shall maintain a continuous study of the problems confronting the chapter and shall keep the chapter informed of the results of any studies. He/She shall prepare information reports for the chapter newsletter in order that all members may have full information of the activities of the Association.

6.2 Vice-President

The Vice-President shall perform the duties of the President in the President's absence or incapacity to serve and shall serve on such committees to which appointed and perform other duties as directed by the President.

6.3 Secretary

The Secretary shall record (or cause to be recorded) the minutes of the Executive Board meetings and shall keep an accurate record of all proceedings of the regular meetings of the Chapter. He/She shall cause the minutes of chapter meetings to be posted on the designated bulletin boards as soon after each chapter meeting as is practicable. He/She shall send and receive correspondence for the chapter.

6.4 Treasurer

a. The Treasurer shall keep accurate account of all money received and pay all bills authorized by the Executive Board. All checks and savings withdrawals shall be signed by the Treasurer and the President, or in the absence of either, by the Vice-President.The Treasurer shall participate in the drafting of the yearly budget.

b. Whenever the Treasurer vacates the office, and at least annually, the President shall cause the books and records to be audited.

c. At each regular meeting of the Executive Board the Treasurer shall present a report.

6.5 Qualifications

All candidates for any of the offices listed in this section must, at the time of their nomination, have been a member of Chapter #600 for at least one (1) year and must have attended at least four (4) Chapter meetings during the year in which the nomination occurs and/or have actively served on committees or in other capacities in the Chapter, or a combination of both which provides indication of positive activity.

6.6 Installation

Installation of officers shall be at the end of the regularly scheduled May meeting. Whether or not installed, officers shall assume office as provided above.

ARTICLE VII - EXECUTIVE BOARD

7.1 The Executive Board shall consist of thirteen (13) members - President, Vice- President, Secretary, Treasurer and nine (9) Area Representatives. Members shall attend all Chapter and Executive Board meetings. Un-excused absences from more than two (2) Chapter meetings or two (2) Executive Board meetings, shall result in dismissal from his/her official position.

Section 1 - Vacancies

a. Office of President: The Vice-President shall fill the unexpired term of President.

b. Vice- President: Shall be filled by the Executive Board with the requirement that the appointee must have seven (7) votes of the Executive Board.

c. Secretary, Treasurer and Area Representatives: Shall be filled by the President with the advice and consent of the Executive Board.

ARTICLE VIII - ELECTIONS

 
Section 1. Re-negotiated contract:
Not less than fifteen (15) days prior to the date of the contract ratification, the Executive Board shall ensure that all bargaining unit members receive a notice of the date, place, and time of the ratification meeting, together with a copy of the changes and such other pertinent data deemed necessary. The ratification of a re-negotiated contract shall be by secreted printed ballot to all members. Members having received ballots shall return ballots to the designated member by the deadline approved by the Executive Board. It shall require a simple majority to ratify a re-negotiated contract.
 
Section 2. Election of Officers:
 
The election of the President, Vice-President, Secretary and Treasurer shall be by secret printed ballot to all members. Write-in candidates are not permitted. If a write-in is made by a voter, it shall invalidate the vote for that office. A plurality only shall be required to elect any officer.
 
Section 3. Counting of Ballots:
 
Ballots shall be counted by members appointed by the Executive Board with at least one (1) member being an elected officer.
 
Section 4. Chapter Dues Change:
 
a. Changes in Chapter dues may be proposed either
 
(1) upon the recommendation of the Executive Board or,
 
(2) by a motion made and passed at a regular or special Chapter meeting.
 
b. Any proposal for changes must be announced in two (2) consecutive Chapter bulletins
and posted on employee bulletin boards, where those are available, for at least thirty (30)
days prior to the date of the proposal is to acted upon.
 
c. Voting will be by secret ballot and conducted essentially as provided for in Section 2, Article
VIII (Elections). Procedures for voting will be outlined on the employee bulletin board notice.
 
d. A simple majority of those balloting will be required for a change in Chapter dues.
 
Section 5. Delegate Election
 
a. Delegates to the Annual OSEA Conference will number up to that amount authorized in the OSEA Constitution.
 
b. The President and Vice-President will automatically be delegates to the Annual Conference.
 
c. All other delegates and alternates will be elected or appointed at the April membership meeting in accordance with adopted policy.
 
d. Delegates to the Annual Conference must have been OSEA members at least six (6) months prior to their designation as delegates and must have attended at least three (3) Chapter meetings during that fiscal year.

ARTICLE IX - COMMITTEES
 
The President, with the advice and consent of the Executive Board, shall create special/standing committees as may be necessary to carry out the goals of the Chapter. At that time, the Executive Committee shall specify the composition of the committee, its duties, and the timelines for its required actions. The Negotiation Committee shall automatically include the elected officers: President, Vice-president, Secretary, and Treasurer. Additional members of the Negotiating Committee shall be appointed by the President, with the advice and consent of the Executive Board.

ARTICLE X - RECALL OF OFFICERS

Section 1: President, Vice-President, Secretary, Treasurer and Region Representatives

If the Executive Board receives a petition bearing the signatures of at least twenty-five percent (25%) dues paying members, or at least twelve (12) Executive Board members requesting that an election be held to recall one (1) or more of these officers, it shall conduct a secret ballot election from among the membership. The ballot shall read:

 

 

 "A valid recall petition, as authorized in Article X of the Chapter's Constitution, having been received by the Executive Board to recall (person's name) as (office) (and additional if more than one is subject to recall). The issue which you must decide is:

Shall __Name__ be recalled as the Chapter's __Office__?

Yes No

(Additional items if more than one is subject to recall.)

 

It requires one (1) more vote of one-half (Y2) of all votes cast to recall for a recall to be effective. If the recall is successful, the office shall be filled as provided for in Section 2, Article Vil of the Constitution.

Section 2, Recall Results

a. The recall results will be posted in the next available Chapter bulletin and the President shall cause building representatives to post the results at work sites.

b. If a person is recalled from an office, he/she shall cease to function in that office immediately following the counting of the ballots by the proper committee.

ARTICLE XI - MEETINGS

11.1 Regular Chapter meetings shall be held monthly in a centrally located place.

11.2 Executive Board meetings shall be held monthly. The time and place of each meeting shall be announced at the regular meeting of the Association. It shall require the presence of seven (7) members of the Executive Board to constitute a quorum.

11.3 Parliamentary Procedures - Robert's Rules of Order, Newly Revised, shall be the basis of the procedure for all committee and Chapter meetings except as may be otherwise provided for in the Constitution.

ARTICLE XII - AMENDMENTS

Amendments to the Constitution of OSEA Chapter #600 must be submitted, in writing, to all members thirty (30) days prior to the regular Chapter meeting at which they will be proposed. A two-thirds (2/3) majority of members present at the regular Chapter meeting will be required for the adoption of any amendments to the Constitution.

Definitions

Member: Employee of Head Start of Lane County who has completed the OSEA enrollment card.

Per Capita Dues: Dues paid to OSEA as determined by members at the annual OSEA conference.

Annual OSEA Conference: Conference held annually and attended by elected members from all OSEA chapters to elect State officers, vote on proposed resolutions to State Constitution.

OSEA Chapter #600 Executive Board: Members elected and appointed to serve as officers and leaders of members of OSEA Chapter #600.
